1. Controller

2. Hosting of this website

This website is delivered via Cloudflare Workers (Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA). When you visit, Cloudflare processes technical access data (IP address, time, requested address, browser identifier) to deliver the page and protect it against attacks and abuse, for example by limiting requests per IP address. The legal basis is Art. 6 (1) (f) GDPR; our legitimate interest is a secure and fast operation. We do not evaluate server logs and only see aggregated access figures without personal reference.

We have a data processing agreement with Cloudflare under Art. 28 GDPR. Transfers to the USA are based on the European Commission's adequacy decision for the EU-US Data Privacy Framework (Art. 45 GDPR), under which Cloudflare is certified, and additionally on the EU standard contractual clauses.

The connection is TLS encrypted. We use no cookies and no analytics or advertising scripts. Fonts and all other content come from our own server; third-party services such as Google Fonts are not loaded.

3. Waitlist

When you join the waitlist, we store your first and last name, email address, your phone number if given, the chosen language and the time and address of the page you signed up through. The data is stored in a database at Cloudflare (D1, located in Western Europe). The purpose is to inform you when Filmetri is available and to be able to reach you with questions. The legal basis is your consent (Art. 6 (1) (a) GDPR). The information is voluntary; without name and email address no entry is possible. We store neither IP address nor browser identifier and do not pass the list on to anyone.

We notify ourselves of every new entry by email. Cloudflare (Email Service) sends that message on our behalf to our mailbox at Hostinger International Ltd. (Larnaca, Cyprus; processing in the EU). We do not send you a confirmation email.

You can withdraw your consent at any time with effect for the future (Art. 7 (3) GDPR); the lawfulness of processing before the withdrawal remains unaffected. An email to hello@filmetri.com is enough and we delete your entry. At the latest three months after the launch of Filmetri we delete the entire list.

4. Contact by email or phone

When you contact us by email or phone, we process your details to answer your request. The legal basis is Art. 6 (1) (b) GDPR if your request relates to a contract or its preparation, otherwise Art. 6 (1) (f) GDPR; our legitimate interest is answering you. Our mailbox is hosted by Hostinger International Ltd. (Larnaca, Cyprus; processing in the EU). We delete requests as soon as they are settled and no statutory retention obligations apply.

5. The Filmetri software

This policy covers the website. For the software: all analyses run on your computer by default, without internet. Data leaves it only if you explicitly choose a cloud provider for a single function in the settings, and only to that provider. Depending on the function this is text (such as transcript excerpts and transcript sentences for search, cut plan, briefing, names and roles of people, search queries), the audio track of a clip for transcription, downscaled still frames for scene detection or, only during a Premiere control run you start, screenshots of Premiere Pro. Facial features and voice profiles never leave your computer. You conclude the contract with the provider yourself using your own account; its privacy terms apply.

The update check asks our server updates.filmetri.com at start and on request whether a new version is available. It sends operating system, processor architecture, installed version and update channel; we store no IP address and no identifier of your computer. The check at start can be switched off (Art. 6 (1) (f) GDPR; our legitimate interest is secure, up-to-date versions). On first start Filmetri also downloads program components and AI models from public sources such as GitHub and Hugging Face; as with any download, the respective provider receives your IP address.

6. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You can withdraw any consent at any time (Art. 7 (3) GDPR). Write to hello@filmetri.com for that.

Where we process data on the basis of Art. 6 (1) (f) GDPR, you can object at any time on grounds relating to your particular situation (Art. 21 GDPR).

You can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), for example with the authority competent for us, the Saxon Data Protection and Transparency Commissioner (Sächsische Datenschutz- und Transparenzbeauftragte), Devrientstraße 5, 01067 Dresden, Germany. There is no automated decision-making or profiling.
